Terms of Service

These Terms of Service ("Terms") govern your use of the Mure platform and services provided by KITFUNSO LTD trading as Mure ("Mure", "we", "us", "our"), a company registered in England and Wales. By creating an account or using our services, you agree to be bound by these Terms.

1. Service Description

Mure provides automated battery charge and discharge optimisation for home energy storage systems. The service connects to your battery hardware via the manufacturer's API, retrieves electricity pricing data from your tariff provider, and computes optimal schedules to minimise your electricity costs.

The service sends charge and discharge commands to your battery automatically based on these computed schedules. You retain full control and can override automated behaviour at any time.

2. Eligibility

To use Mure, you must:

  • Be a resident of the United Kingdom
  • Be at least 18 years of age
  • Have a compatible battery energy storage system (currently GivEnergy systems; additional manufacturers may be supported in future)
  • Have an active time-of-use electricity tariff (such as Octopus Agile) or another tariff supported by the platform

3. Your Account

  • You are responsible for maintaining the confidentiality of your account credentials. Do not share your password with anyone.
  • One account per person. Creating multiple accounts to circumvent service limitations is prohibited.
  • You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.
  • You must provide accurate information when creating your account. This includes a valid email address and the correct postcode for your property.

4. Device Control and Override

By activating Mure on your battery system, you grant us permission to send charge and discharge commands to your battery via the manufacturer's API (e.g. GivEnergy Cloud API). These commands are issued automatically according to the optimised schedule.

Your override rights:

  • You can switch your battery to Eco mode (manual/manufacturer control) at any time via the Mure app. This immediately stops Mure from sending further commands until you re-enable automation.
  • Override takes effect within one polling cycle (maximum 5 minutes).
  • Mure will never prevent you from regaining manual control of your battery.
  • The battery reserve minimum you set in your preferences is never breached by the optimiser. Your battery will not be discharged below this level.

Important:all commands we send to your battery use the manufacturer's approved API and are within the manufacturer's documented operating parameters. We do not modify firmware, bypass safety systems, or send commands outside the manufacturer's API specification.

5. Pricing

Mure is currently free to use during the beta period. We may introduce paid plans in the future. Any pricing changes will be published on our website and communicated to registered users by email with at least 30 days' notice before taking effect.

You will never be charged without explicit opt-in to a paid plan.

6. No Guarantee of Savings

Mure aims to reduce your electricity costs by optimising when your battery charges and discharges. However, actual savings depend on many factors outside our control, including:

  • Your electricity tariff and its pricing structure
  • Your household energy consumption patterns
  • Electricity market conditions and price volatility
  • Your battery capacity, health, and efficiency
  • Weather conditions affecting solar generation (if applicable)
  • Changes to tariff terms by your energy supplier

Past performance and savings estimates displayed in the app are not indicative of future results. We do not guarantee any specific level of savings.

7. Limitation of Liability

To the maximum extent permitted by law, KITFUNSO LTD trading as Mure shall not be liable for:

  • Hardware damage:any damage to your battery, inverter, or other electrical equipment. We only issue commands through the manufacturer's approved API within documented parameters.
  • Electricity costs: any increase in your electricity costs resulting from use of the service, including costs arising from suboptimal schedules, missed schedules, or incorrect pricing data.
  • Missed or delayed schedules: failure to execute a charge or discharge command due to API outages, network issues, or service interruptions.
  • Third-party API outages: downtime or errors in the GivEnergy Cloud API, Octopus Energy API, or any other third-party service we depend on.
  • Incorrect pricing data: errors or delays in electricity pricing data provided by third-party tariff APIs.
  • Indirect or consequential losses: including but not limited to loss of profit, loss of data, or business interruption.

If our battery failsafe is triggered (e.g. the manufacturer's API becomes unreachable), Mure will automatically revert your battery to Eco mode (manufacturer-default behaviour) to protect your system.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

8. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Reverse engineer, decompile, or disassemble any part of the service
  • Use the service to manipulate electricity markets or engage in market abuse
  • Exceed reasonable API usage limits or abuse the service infrastructure
  • Share your account credentials with third parties

9. Data and Privacy

Your use of Mure is also governed by our Privacy Policy, which explains what data we collect, how we use it, and your rights under the UK GDPR. By using the service, you acknowledge that you have read and understood our Privacy Policy.

10. Intellectual Property

The Mure platform, including its software, algorithms, user interface, and branding, is the intellectual property of KITFUNSO LTD trading as Mure. You are granted a limited, non-exclusive, non-transferable licence to use the service for personal, non-commercial purposes in accordance with these Terms.

Your telemetry data and usage data remain yours. We do not claim ownership of your personal data.

11. Service Availability

We aim to provide the service with reasonable uptime but do not guarantee uninterrupted availability. We may suspend or restrict access to the service temporarily for maintenance, updates, or to address security issues. We will endeavour to provide advance notice of planned maintenance where practicable.

12. Termination

  • By you: you can delete your account at any time from the Settings page in the app or by emailing [email protected]. Upon deletion, we will stop sending commands to your battery, revert it to Eco mode, and delete your personal data in accordance with our Privacy Policy.
  • By us: we may suspend or terminate your account if you breach these Terms, engage in abusive behaviour, or if we reasonably believe your use of the service poses a risk to our systems or other users. We will notify you by email if we take such action, with reasons, unless doing so would compromise security.
  • Effect of termination: upon termination, your right to use the service ceases immediately. We will revert your battery to Eco mode. Sections that by their nature should survive termination (including Limitation of Liability, Intellectual Property, and Governing Law) will continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify registered users by email at least 14 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you may delete your account before they take effect.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
